VID2SCENE TERMS OF USE

1. ACCEPTANCE OF TERMS
By accessing or using the vid2scene platform ("Service") provided by SamuSynth, Inc. ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. SERVICE DESCRIPTION
Vid2scene is a software platform that transforms 2D phone videos into immersive 3D environments using Gaussian Splatting and other technologies. The Service is provided on an "as is" and "as available" basis.

3. ACCOUNT REGISTRATION
To access certain features of the Service, you may need to register for an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activities that occur under your account.

4. ELIGIBILITY
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

5. USER CONTENT
5.1 Ownership
You retain ownership of all content you upload to the Service ("User Content") as well as the 3D models generated from your content. By uploading User Content, you grant us a limited license to access, store, and process such content as necessary for: (1) providing, maintaining, and improving the Service; (2) diagnosing and resolving technical issues and bugs; (3) complying with legal obligations; and (4) enforcing our Terms. We will not use your content for marketing purposes or sell it to third parties without your explicit consent.

5.2 Download Rights
Users may download and export their generated 3D environments for personal and commercial use in accordance with these Terms.

5.3 Restrictions
You agree not to upload content that:
  • Infringes on intellectual property rights
  • Contains private or personal information without proper consent
  • Violates any applicable law or regulation
  • Contains malicious code or harmful components
  • Depicts illegal activities or obscene material

6. PRIVACY AND DATA
6.1 Privacy Policy
Your use of the Service is governed by our Privacy Policy, available at vid2scene.com/privacy, which is incorporated by reference into these Terms.

6.2 Data Retention
During the beta period, all data uploaded to the Service is stored in the cloud but may be deleted at any time without notice. Future paid tiers may offer guaranteed storage periods. We recommend maintaining backup copies of your important content.

7. INTELLECTUAL PROPERTY
7.1 Company Property
The Service, including its software, features, and content (excluding User Content), is owned by the Company and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purposes.

8. SERVICE LIMITATIONS
8.1 Usage Limits
The Service may impose usage limitations based on IP address or other factors. Future paid tiers may offer higher usage limits.

8.2 Availability
During the beta period, the Service is provided without guarantees regarding uptime, availability, or performance. We will make reasonable efforts to maintain service availability but reserve the right to temporarily suspend access for maintenance or other purposes without prior notice.

9. PROHIBITED ACTIVITIES
You agree not to:
  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Reverse engineer, decompile, or disassemble the software
  • Use automated methods to access or use the Service
  • Resell or commercially exploit the Service without authorization

10. DISCLAIMERS
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12. INDEMNIFICATION
You agree to indemnify and hold harmless the Company from any claims, damages, liabilities, costs, or expenses arising from your use of the Service or violation of these Terms.

13. TERMINATION
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice.

14. CHANGES TO TERMS
We may modify these Terms at any time. We will provide notice of significant changes through the Service or by other means. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

15. GOVERNING LAW AND JURISDICTION
These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of California, in each case located in the County of Santa Clara.

16. BETA SERVICE DISCLAIMER
Vid2scene is currently offered as a beta service. Features, functionality, and availability may change without notice. Data persistence and quality cannot be guaranteed during the beta period.
